Terminology

"YOU/YOUR" and/or "THE CLIENT" – Refers to the person considering or contacting us via email, social media, or the contact form provided.

"WE", "US", "OUR", "DAWN SKY FILMS Ltd", "(DSF)" or "ME" and "I" – Refers to AJ Lamb and/or any officially appointed member of DSF contracted by AJ Lamb on a freelance basis.

1. Services

Dawn Sky Films Ltd. provides film production services, including but not limited to:

  • Narrative and Digital Content Production

  • Corporate and Commercial Content Production

  • Headshots and Showreels

We also offer the following additional services:

  • Logistics Management

  • Talent and Location Acquisition

  • Equipment Packages

  • Post Production Management

Each service is provided under a separate, individually tailored contract, which includes a full breakdown of the terms and conditions specific to the client's project.

2. General

By contacting us and using this website, you confirm that you are at least 18 years of age or have the supervision and/or permission of your parent(s) or guardian. DSF does not knowingly engage in any business with persons under the age of 18 without the permission/supervision of a parent or guardian.

2A. Images and Advertising

Use of AI-Generated Content

Our website may feature AI-generated text and images, including but not limited to content created using language models like ChatGPT and visual representations generated by artificial intelligence. These elements are intended solely for illustrative purposes, to provide visual or descriptive representations of the products or services we offer.

While we strive to present accurate and high-quality representations, please be aware that AI-generated content may not always reflect the exact nature of the product or service. The AI-generated images and text may be modified or adapted from their original forms for use on this site.

3. Pricing

All prices listed on our website are indicative and subject to change. Final pricing will be determined based on the specific requirements of each project and in accordance with current government regulations. A formal quote will be provided upon request.

4. Payment Terms

All our services require a non-refundable percentage deposit to secure the booking and cover the company’s upfront costs. This percentage is determined by the length of the production and its logistical requirements, and we will inform you of the deposit amount beforehand.

After the agreed milestone, most of our payment terms fall due within 14-28 days, except for upfront costs or costs of any additional or last-minute changes. Failure to make payments may result in delays or cancellation of services. If payment is not received within the specified time, we may take legal action or action to recover lost costs by any means necessary.

5. Cancellation and Refunds

Cancellations must be made in writing. Deposits are non-refundable unless otherwise agreed. Refunds, if applicable, will be processed at our discretion based on the project’s progress. Full cancellation and refund terms will be outlined in the individual contracts.

Refunds and cancellations may be accepted on a project-by-project basis. Clients have the right to cancel the contract at any time; however, refunds are not always guaranteed depending on the reasons for the cancellation and how much work has already been completed.

6. Liability

Dawn Sky Films Ltd. makes every effort to ensure the quality and timeliness of our services. However, we are not responsible for delays or failures due to unforeseen circumstances, such as weather, equipment failure, illness, or government restrictions.

Our liability is limited to the amount paid for the services in dispute.

7. Intellectual Property

Dawn Sky Films Ltd. retains ownership of all creative assets until full payment is received. Clients must ensure they have the rights to any third-party content provided for production.

8. Contacting Us

When contacting DSF, you acknowledge that your information, such as your name, mobile or home phone number (if provided), and address (if provided), shall be stored by us in our contacts list and email provider (Gmail).

You agree that DSF and its official contractors shall NOT be held liable for any breach of privacy and/or personal information that may be leaked due to events or mishaps with our email provider (Google/Gmail). DSF does not sell your information to any third parties.

We may contact you regarding your project, troubleshooting, dispute resolution, payment collection, updates, or legal matters. This may be via email, telephone, text messages, social media private messaging, or postal mail.

9. Social Media

By contacting us through any social media platform, you agree and understand that DSF holds no responsibility for any breach of your private and personal information. You also agree not to defame or seek legal injunctions against AJ Lamb/DSF or any past, current, or future projects carried out by AJ Lamb.

DSF may follow and connect with you on social media handles to help promote you and/or any project you are involved in with DSF/AJ Lamb. If you require specific holdbacks or NDAs on the material, you must inform us before principal photography begins. DSF cannot enter into agreements with NDAs lasting indefinitely or exceeding one year.

10. Privacy Policy

Dawn Sky Films Ltd. is committed to protecting your privacy. This policy outlines how we collect, use, and protect your personal data.

DSF/AJ Lamb collects personally identifiable information when you visit our site, including:

By following DSF on social media, you acknowledge that you may see promotional or advertising material posted by us, although we cannot control who sees this content on those platforms.

If you would prefer not to receive promotional material from us, please notify us directly via email, and we will ensure your preferences are respected for email communication. Additionally you can block or unfollow us on social media to help prevent our material being shown to you. Instagram also offers you the option to click “ Not interested” on posts you see to help prevent you seeing more in future.

You acknowledge that whilst We cannot fully control what Instagram shows people.

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales, and you agree to submit to the exclusive jurisdiction of the courts located in England and Wales.

2. Entire Agreement

These Terms and Conditions, along with any individual contracts or agreements signed for specific services, represent the entire understanding between the parties. Any changes or amendments to this agreement must be made in writing and signed by both parties.

3. Severability

If any provision of these Terms and Conditions is deemed invalid, illegal, or unenforceable by any court of competent jurisdiction, the validity of the remaining provisions shall not be affected, and the invalid or unenforceable provision will be amended to reflect the parties' original intent as closely as possible.

4. Force Majeure

Neither party shall be held liable for any failure to perform or delay in performance of any obligations under these Terms and Conditions due to circumstances beyond their reasonable control, including, but not limited to, acts of God, war, terrorism, strikes, labor disputes, government restrictions, technical failures, or illness of key personnel.

5. Waiver

Failure by either party to enforce any right or provision under these Terms and Conditions shall not be deemed a waiver of such right or provision, nor shall it affect the validity of these Terms and Conditions. However, any right or provision must still be enforced within the legal timeframes and limits established by law.
